Judge grants second psych evaluation

Michael David Bough, 49, appeared in Lenawee County Circuit Court by video on Wednesday, Dec. 23 for arraignment on five counts of third-degree criminal sexual conduct and one count of second-degree sexual conduct for having an inappropriate relationship with a 17-year old Tecumseh High School (THS) student. Bough was the former band and orchestra director for THS. On December 23, a second opinion was ordered to determine if Bough is capable of aiding in his own defense against the charges.

In circuit court, public defender Dawn Van Dusen entered not guilty pleas for Bough before Judge Margaret M.S. Noe during his arraignment. Van Dusen requested an independent psychological evaluation by a local psychiatrist, and told the court Bough has been on suicide watch since he entered jail after his arrest on August 7. Van Dusen said Bough is suffering from severe depression and is receiving mental health treatment. Bough agreed with the request. Angela Borders, Assistant Lenawee County Prosecutor, said her office had no objection to a second evaluation. Noe granted the motion for the court to pay for the second competency test.

The charges against Bough carry up to 15-year prison terms. In August, a psychological evaluation was ordered for Bough after a preliminary hearing in district court. The state psychologist who evaluated Bough found him competent. Bough waved a preliminary examination in district court after a judge ruled him competent on December 14 to stand trial.

Bough is accused of using his position at THS to coerce a student into having sex with him for several months. The abuse was discovered by THS principal Griff Mills on July 23. The Lenawee County Prosecutor’s Office issued a six-count felony for his arrest. Bough was arrested by the Tecumseh Police Department with assistance by the University of Michigan Police. Bough is currently held at Lenawee County Jail on a $1.5 million dollar bond.

The case will go to trial before Judge Anna Marie Anzalone. No hearing dates are scheduled at this time.
