Scooter crash lawsuit going to jury trial

ADRIAN — A lawsuit filed by a family of a Tecumseh man injured in a scooter crash at the Adrian Mall will proceed to jury trial in a decision made Monday, March 23, in Lenawee County Circuit Court. Arnold Naebeck, 85, was injured in 2012 after a fall from his motorized wheelchair while at the mall for his great-grandson’s birthday party.Naebeck died in 2013 from causes unrelated to the neck injury he received in the accident at the mall. Judge Margaret Noe found in favor of a jury trial after looking at photos of the accident scene that were taken right after the incident occurred.The photos showed broken concrete as the hazard that caused Naebeck’s scooter to flip over as he rode it down a sidewalk ramp. The mall owner at the time of the accident, Greenland Vistas, claimed it was not responsible for the deterioration on the ramp because Jones Lang LaSalle Americas, Inc. managed the mall.Noe ruled a jury must also determine the liability of Greenland Vistas in the case. A court date for the jury trial has not been set.
